CamClo3D Affiliate Program Terms of Service

1. Program Enrollment

To become an Affiliate, the individual or entity must submit an application through our website and provide all necessary information requested by CamClo3D. CamClo3D reserves the right to accept or reject any application for any reason at its sole discretion. Joining the Program requires an application submission, acceptance of these ToS, and provision of valid payout details.

2. Program Rules

Your participation is subject to the following Rules. Violations may result in termination and forfeiture of commissions:

• Compliance with Laws: You must ensure all promotional efforts adhere to applicable laws, including advertising standards, anti-spam regulations, consumer-protection laws, and the disclosure/endorsement guidelines applicable in every jurisdiction where you or CamClo3D operate.
• Disclosure Requirement: Clearly display a disclaimer stating your independent status, that your opinions are your own and not official statements of CamClo3D, and that your earnings are derived from referral compensation.
• Non-Disparagement: Refrain from publishing disparaging comments about CamClo3D, its staff, or its products. Avoid negative remarks about competitors for promotional gain.
• Social Media Requirements: Follow each platform's rules and clearly disclose the promotional nature of your content (e.g., "#ad", "Sponsored", "Paid Ad"). You must not publish your referral link on CamClo3D's own social pages or website, nor create accounts, pages, or groups using CamClo3D's names, trademarks, or logos.
• Marketing Claims: Promotional content must not guarantee user success, misrepresent our services, or contain false or deceptive advertising.
• General Advertising Rules: Your advertising must not infringe on the rights of others, contain offensive content, employ harmful software, or use technology that diverts traffic or affiliate payments.
• PPC / Brand-Bidding Restrictions: Without prior written permission, you may not bid on CamClo3D brand keywords (including negatives), use them in ad copy or domain names, or impersonate CamClo3D on search engines. Direct linking and misrepresentative bidding are prohibited.
• No Mimicking: Your website must not copy, resemble, or mirror CamClo3D's website or create the impression that it is operated by or affiliated with CamClo3D.

3. Affiliate Conduct

• You shall promptly respond to all communications from CamClo3D and provide all requested information related to your affiliate activity.
• You are responsible for ensuring your employees, agents, and representatives comply with this Agreement; their violation is deemed your violation.
• You are prohibited from illegal or deceptive SEO practices, including 'black hat' techniques and paid search results using CamClo3D's or competitors' trademarks.
• You may not offer monetary incentives (rewards points, cash, prizes) to prospects in exchange for engagement with a promotion.
• You must use the referral links we supply without altering or modifying them.
• Self-referral is not permitted; commissions are earned only from transactions made by others using your referral link.
• You must not engage in deceptive, manipulative, or fraudulent activity, cookie stuffing, misleading links, or concealment of originating URL information.
• You must not send unsolicited bulk email, text spam, form spam, social spam, or any communication to which recipients have not consented.
• You must not place advertisements on sites containing adult content, weapons, graphic violence, drugs, gambling, discriminatory, or fake-news content.
• You may only use images, text, and content provided by CamClo3D as authorized, without alteration. All trademarks and trade names are reserved.
• You must not offer discounts, coupons, free trials, promo codes, or cashback not expressly authorized by CamClo3D in writing.
• Promotion through a sub-affiliate network is not permitted unless expressly agreed in writing by CamClo3D.

4. Compensation

Upon acceptance, you will receive a unique referral code and link used to track your promotional efforts. The Program operates on a tiered commission structure based on your total number of successful referrals:

• Tier 1: 10% commission (referrals 1 to 50)
• Tier 2: 20% commission (referrals 51 to 100)
• Tier 3: 30% commission (referrals 101 and above)

Commission is calculated on the payment amount of qualifying subscriptions for a period of three (3) monthsfrom each referred user's first payment, provided that user remains subscribed.

Tier locking: Each referral is locked to the commission tier in effect at the time the referral was made. If you later qualify for a higher tier, only referrals made after qualifying earn the higher rate; existing referrals remain at their original tier for their full commission duration.

Attribution & eligibility: Commission is generated only for new sign-ups attributed to your referral cookie (last-touch attribution, 30-day cookie window). Unattributed sign-ups, self-referrals, and sign-ups made in violation of this Agreement are not eligible. CamClo3D reserves the right to allocate commissions differently in cases of cancellation-and-resubscription, self-referral, or other circumstances at its discretion.

Pending period & payout: Commissions are held in a "pending" status for thirty (30) days before becoming payable, to account for refunds and chargebacks. Commissions for payments that are later refunded or charged back are considered unearned and will be deducted from future payouts.

Payout methods: You may elect to receive your earnings as (a) platform credits applied automatically to your CamClo3D account, or (b) cash payouts via PayPal, bank transfer, or UPI (UPI available to India-based affiliates only). Cash payouts require a minimum accumulated balance of US $25 and valid payout details on file.

Payment fees & taxes: Affiliates are responsible for any payment-processing, transfer, currency-conversion, or intermediary fees associated with their chosen cash payout method, and such fees may be deducted from the payout amount. You are solely responsible for all taxes applicable to your commissions in your jurisdiction, and CamClo3D may withhold or deduct tax where required by law, and may request tax documentation before processing payments.

No commission is earned if, at the time of payout, you do not have a usable payout account or CamClo3D cannot process payment due to incomplete or inaccurate information. CamClo3D reserves the right to withhold or reclaim commissions for sales deemed fraudulent, in violation of this Agreement, or illegal, and may terminate your participation immediately.

An account managed or used by you or your agency is classified as a self-referral. An account actively managed and used by your clients or external third parties is recognized as a legitimate referral.

5. Intellectual Property

Conditioned on your continued compliance, CamClo3D grants you a limited, revocable, non-exclusive license to use CamClo3D trademarks and marketing materials solely for promoting our services under the Program's scope. Nothing in this Agreement grants you any right, title, or interest in CamClo3D materials beyond this limited license. All intellectual property rights related to the Program remain owned by CamClo3D.

6. Confidentiality

"Confidential Information" means any non-public information disclosed by CamClo3D to you in connection with this Agreement or the Program. You will protect such information using at least reasonable care and will not use it for any purpose other than that for which it was disclosed.

7. Term and Termination

This Agreement commences upon your acceptance or CamClo3D's approval of your participation and continues on a month-to-month basis until terminated. Either party may terminate for any reason without notice. If you breach or attempt to breach this Agreement or violate any law in your dealings with CamClo3D, we may terminate this Agreement or suspend your access without notice, suspend any accounts you hold with us, and you will forfeit any commissions or payments due. Provisions intended to survive termination, including liability limits, warranty disclaimers, indemnity obligations, and dispute-resolution terms, remain in effect.

8. Legal Provisions

Limitation of Liability: Your participation in the Program, including marketing materials, tracking, and links, is at your own risk and provided on an "as is" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, CamClo3D and its affiliates, directors, employees, and agents will not be liable for any indirect, incidental, special, exemplary, or consequential damages, lost profits, or lost data arising out of your use of or inability to use the Program. In no event shall CamClo3D's aggregate liability exceed one hundred US dollars (US $100).

Indemnification: You agree to indemnify, defend, and hold harmless CamClo3D and its affiliates from any claim, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your participation in the Program, your breach of this Agreement, or your violation of any law or third-party right.

Dispute Resolution & Governing Law: This Agreement is governed by the laws of India, without regard to conflict-of-law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh, India. The parties will first attempt in good faith to resolve any dispute directly; disputes that remain unresolved after forty-five (45) days may be referred to binding arbitration in Indore, Madhya Pradesh, in accordance with the Arbitration and Conciliation Act, 1996. The parties waive any right to a class action.

9. Modifications to the ToS

We reserve the right to modify these ToS at any time. Continued participation after modifications signifies acceptance.

10. General Provisions

Independent Contractor Relationship: You are an independent contractor; nothing herein creates a partnership, joint venture, or employment relationship.

Entire Agreement: These ToS constitute the entire agreement between you and CamClo3D regarding the Program.
